Welcome to FoodOye. These Terms and Conditions (“Terms”) govern your use of our website, mobile application, and related services (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Nature of Our Services
FoodOye is an online ordering platform that allows customers to browse menus, place orders, and make payments to participating restaurants (“Restaurants”). We are not a food provider, manufacturer, or delivery company. The preparation, quality, and delivery of food are the sole responsibility of the Restaurant you place an order with.
2. Eligibility
You must be at least 16 years old, or have the consent of a parent or legal guardian, to create an account and use our Platform.
3. Ordering and Payment
- When you place an order through our Platform, you are entering into a direct contract with the Restaurant.
- All payments (Cash on Delivery, JazzCash, Easypaisa, or Card payments, where available) are handled directly by the Restaurant.
- Our Platform does not collect, process, or hold any payments, and we are not responsible for issues related to payment, refunds, or disputes.
- Prices and availability of menu items are determined by Restaurants and may change without notice.
4. Restaurant Responsibility
The Restaurant is solely responsible for:
- Preparing and packaging food items.
- Ensuring food safety, quality, and hygiene.
- Delivery or pickup of orders (if offered).
- Receiving payments directly from the customer.
- Paying the agreed service fee / platform fee to the Company.
FoodOye does not guarantee delivery times, food quality, or order accuracy.
5. User Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate and up-to-date information when placing orders.
- You must not misuse the Platform, including fraudulent orders or chargebacks.
6. Refunds and Complaints
All refunds, replacements, complaints, or disputes must be addressed directly with the Restaurant. While we may facilitate communication, the Restaurant remains solely responsible for resolving such matters. You may also submit complaints/feedback and rate Restaurants via our Platform.
7. Third-Party Links
Our Platform may contain links to third-party websites. We are not responsible for their content, policies, or actions.
8. Suspension or Termination
We may suspend or terminate your access to the Platform immediately if you violate these Terms, abuse our services, or engage in fraud.
9. Service Fee and Account Suspension
Restaurants must pay the agreed service fee on a weekly or monthly basis. Failure to pay may result in suspension or permanent removal from the Platform.
Outstanding dues remain payable in full. Non-compliance will be treated as a serious breach.
10. Limitation of Liability
To the fullest extent permitted by law, FoodOye shall not be liable for issues arising from:
- Food preparation, quality, or delivery delays by Restaurants.
- Health or safety concerns related to food items.
- Errors or omissions by Restaurants in fulfilling orders.
11. Governing Law
These Terms are governed by the laws of the jurisdiction where our company is registered.
